Theft, Theft, My images are not public domain!

I was checking messages, and came across a message from telling me that he used my drag racing image in his friends website. I go to his deviantart page and there is noting in his gallery and only 11 views. SO he only came to DA to fish  This message was sent Oct 25. I was out of town and somehow missed the message... I check the link that the message supplied and sure enough, there is my image! www.pumpingadrenaline.com/inde… ! I really think there needs to be a better means for deviant art to lock down images that are posted by subscribers.... Man this really pisses me off..... Now i am going to have flippin water mark everything. I have just fired off a message to the website about taking down my image. I have feeling this is going to be a nightmare! It would not bother me so bad if it was just  fan site, However these guys are marketing merchandise! If they are marketing merchandise then they are going to pay me for using my image!...... there where quite a few  deviatart image stolen or used or borrowed.
The note said that credit was given for stealing my image!
I did not give permission for my image to be used, therefor its stolen. Its not public domain and fair game..... dammit this really make mad
